1. Welcome
Welcome to The Little Capsule Co.
These Terms of Service ("Terms") govern your access to and use of:
- www.thelittlecapsuleco.com.au;
- any associated websites or subdomains;
- our physical retail store;
- our online store;
- live selling platforms operated by TLCco;
- our Buy Back Program;
- community events operated by TLCco; and
- any other products or services provided by THE LITTLE CAPSULE CO. PTY LTD.
The Services are owned and operated by THE LITTLE CAPSULE CO. PTY LTD (ABN 51 758 106 643) ("TLCco", "we", "our" or "us").
By accessing our Services, creating an Account, placing an Order, participating in our Buy Back Program or otherwise using our Services, you agree to be bound by these Terms.
If you do not agree with these Terms, you must not use our Services.
2. Our Policies
These Terms incorporate the following policies, each of which forms part of these Terms:
- Return & Refund Policy
- Circular Credit & Buy Back Policy
- Shipping Policy
- Privacy Policy
- Contact Information
Where one of these policies specifically governs a matter, that policy prevails to the extent of any inconsistency with these Terms.
Nothing in these Terms excludes, restricts or limits any rights you may have under the Australian Consumer Law.
3. Interpretation & Operational Discretion
These Terms are intended to operate together with the policies referred to in Clause 2.
Where these Terms provide TLCco with discretion, that discretion will be exercised reasonably and in good faith having regard to the circumstances.
From time to time, TLCco may choose to make a goodwill gesture or an exception to a policy in exceptional circumstances.
Any such decision:
- does not amend these Terms or any Policy;
- does not create a precedent;
- does not create an ongoing entitlement for you or any other customer; and
- does not require TLCco to make the same decision in future.
Nothing in this clause limits your rights under the Australian Consumer Law.
4. Eligibility
To create an Account or place an Order you must:
- be at least 18 years of age; or
- be acting with the supervision and consent of a parent or legal guardian.
You warrant that all information supplied to TLCco is accurate, complete and current.
5. Customer Accounts
You are responsible for maintaining the confidentiality of your Account credentials and for all activity occurring under your Account.
You must not:
- create or operate multiple customer Accounts without our written approval;
- use another person's Account or Store Credit;
- allow another person to use your Account;
- provide false or misleading information;
- use your Account to circumvent these Terms or any TLCco policy.
Where we reasonably believe an Account has been misused, we may suspend or terminate that Account.
6. Orders
All Orders are subject to acceptance by TLCco.
An order confirmation acknowledges receipt of your Order only and does not constitute acceptance.
We may refuse or cancel an Order before dispatch where reasonably necessary, including where:
- stock is unavailable;
- payment cannot be authorised;
- an obvious pricing or website error has occurred;
- fraud is suspected;
- these Terms have been breached; or
- we reasonably believe an Order is intended to circumvent our policies.
TLCco also reserves the right to limit purchase quantities or decline Orders where we reasonably believe products are being purchased for unauthorised commercial resale.
If an Order is cancelled before dispatch, any payment received will be refunded using the original payment method where possible.
7. Pricing
Unless otherwise stated:
- all prices are in Australian Dollars (AUD);
- prices include GST where applicable;
- shipping charges are additional.
While we take reasonable care to ensure pricing accuracy, occasional errors may occur.
Where an obvious pricing error is identified before dispatch, TLCco may cancel the affected Order and provide a full refund.
8. Payment
Payment must be successfully authorised before an Order is accepted.
TLCco reserves the right to undertake reasonable payment verification and fraud prevention measures before accepting an Order.
9. Product Information
We take reasonable care to ensure product descriptions are accurate.
For one-of-a-kind products, including Rescue and Gently Worn items, the following form part of the product description:
- photographs;
- condition grading;
- written condition notes; and
- product descriptions.
Minor variations caused by lighting, photography or individual display settings do not constitute a fault.
Returns, refunds and exchanges are governed exclusively by our Return & Refund Policy.
10. Intellectual Property
Unless otherwise stated, all content appearing within our Services remains the property of TLCco or its licensors.
You must not copy, reproduce, modify, distribute or commercially exploit any content without our prior written consent.
11. Promotions
Promotions are governed by these Terms together with any promotion-specific conditions published by TLCco.
Where promotion-specific conditions differ, those conditions prevail for that promotion only.
Unless expressly stated otherwise:
- promotions cannot be exchanged for cash;
- promotions cannot be combined;
- promotions remain subject to stock availability.
12. Customer Conduct
We are committed to providing a respectful, safe and welcoming environment for our customers, staff, volunteers, contractors and community partners.
Customers must not engage in behaviour that is abusive, threatening, intimidating, discriminatory, defamatory, harassing or otherwise unreasonable.
This applies to all interactions including:
- in-store;
- online;
- telephone;
- email;
- social media;
- live sales; and
- any other communication with TLCco.
Where we reasonably believe such behaviour has occurred, we may:
- refuse service;
- cancel Orders;
- decline Buy Back submissions;
- suspend customer Accounts; or
- require a customer to leave our premises.
13. Fraud & Policy Circumvention
Customers must not knowingly attempt to manipulate or circumvent these Terms or any TLCco policy.
Examples include:
- operating multiple Accounts;
- using another person's Store Credit;
- providing false information;
- manipulating promotions;
- engaging in fraudulent payment activity;
- attempting to pressure staff into making exceptions contrary to published policies.
Where we reasonably suspect such conduct, we may:
- cancel Orders;
- suspend Accounts;
- reverse incorrectly issued Store Credit;
- decline future Orders;
- refuse future participation in our Services.
14. Limitation of Liability
Nothing in these Terms excludes or limits rights that cannot lawfully be excluded under the Australian Consumer Law.
Subject to those rights, TLCco excludes liability for indirect, incidental or consequential loss to the maximum extent permitted by law.
15. Force Majeure
TLCco is not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, industrial disputes, supply chain disruption, government action, transport interruptions or telecommunications failures.
16. Changes to these Terms
We may amend these Terms from time to time.
The current version will always be published on our website.
Changes apply from the date of publication and do not affect Orders already accepted unless required by law.
17. Governing Law
These Terms are governed by the laws of the Australian Capital Territory.
Any dispute arising under these Terms will be subject to the non-exclusive jurisdiction of the courts of the Australian Capital Territory.
18. Definitions
Account means a customer account held with TLCco.
Buy Back Program means TLCco's appraisal program under which eligible items may be assessed for purchase by TLCco.
Circular Credit or Store Credit means credit issued under the Circular Credit & Buy Back Policy.
Order means a purchase submitted through our Services.
Retail Store means TLCco's physical retail premises in Pearce, Australian Capital Territory, together with any replacement premises operated by TLCco.
Services means the website, Retail Store, Buy Back Program, live sales, community events and any other products or services operated by TLCco.
TLCco, we, our and us mean THE LITTLE CAPSULE CO. PTY LTD (ABN 51 758 106 643).
